Collin county man indicted for less than 1 gram of methamphetamine. Challenged the lawfulness of the search with a hearing on a motion to suppress.  Judge agreed that the search was unlawful.  Motion to Suppress granted.  Prosecution dismissed the charge.

Result: DISMISSED; Motion to Suppress granted.

Online pharmacy distribution of controlled substances

On defense team that defended online pharmacy for six charges related to the sale of prescription drugs. Client faced charges in Oklahoma City federal court. Charges included distribution of controlled substances, conspiracy, and felony misbranding of a pharmaceutical drug. Jury found client pharmacy not guilty on all six counts.

Result: NOT GUILTY

Dallas county man indicted for three offenses relating to Manufacturing and Delivery of Heroin, first-degree felony. Sentenced to five years deferred probation.

Dallas county man indicted for three offenses relating to Manufacturing and Delivery of Heroin and possession of cocaine. Sentenced to five years deferred probation.

Possession of black tar heroin

Dallas man stopped by Dallas police officer because his license plate was too dirty to read.  At a suppression hearing, the State could not prove a lawful search of the vehicle, where the officers found black tar heroin, a state jail felony.  Judge granted a motion to suppress as the result of an illegal search, and the drugs were not admissible. The state dismissed the charge due to losing the hearing.

Result: DISMISSED

Possession of cocaine with intent to deliver

Dallas man indicted for second degree felony of possession of cocaine with intent to deliver.  Dallas Police Department entered a neighbor’s apartment, where they found four African-American males, three visitors and one resident, and cocaine in a closet.  Client was a visitor and only man arrested by DPD. After a jury trial, the judge granted a mistrial due to the hung jury.  As a result, years later, the defendant pled no contest to a misdemeanor count of attempted possession and received deferred probation.

Result: Hung jury–mistrial; State reduced to misdemeanor

Possession of Marijuana, Misdemeanor, Class B Misdemeanor.  Traffic stop for failure to maintain a single lane.  Evidence planted in passenger client’s purse.
